These Terms of Use govern your access to and use of KinSignal, including the mobile app, website, and related services.
1. Acceptance of Terms
By creating an account, downloading the app, accessing the website, or using KinSignal, you agree to these Terms of Use. If you do not agree, do not use KinSignal.
2. What KinSignal Is
KinSignal is a family wellbeing check-in and private emergency notes app. It is designed to help users record check-ins, notify trusted contacts when a scheduled check-in is missed, and optionally prepare selected private text notes for encrypted release under the user's chosen release settings.
3. Important Service Limitations
- KinSignal is not an emergency service.
- KinSignal is not a medical monitoring app.
- KinSignal is not a legal will or estate planning service.
- KinSignal does not verify real-world personal status.
- KinSignal is not an aged care replacement.
- KinSignal does not confirm death, emergency, health status, personal safety, or wellbeing.
- Missed check-in alerts and note release are based on configured rules and account conditions only.
- Alert delivery and note release may be delayed or unavailable.
- Delivery cannot be guaranteed.
4. Eligibility and Accounts
You must provide accurate account information and keep your login credentials secure. You are responsible for activity under your account and for maintaining access to your device, email, and login details. If you believe your account has been used without permission, you should change your password and contact support promptly.
5. Trusted Contacts
You may add trusted contacts to receive missed check-in alerts and, where you explicitly configure it, selected encrypted private note releases. Trusted contacts may be invited by email or QR flow and may create their own KinSignal account to accept. A person may be both a KinSignal user for their own check-ins and a trusted contact for someone else.
6. Check-Ins, Alerts, and Timing
KinSignal may send local reminders, email alerts, and supported push notifications based on your settings, plan, device state, and trusted contact setup. A missed check-in means only that a scheduled app response was not recorded within the configured timing. It does not confirm any particular real world event or condition.
7. Private Note Release
Private notes are not shared by default. Release is optional and must be explicitly enabled by the owner. Only selected text notes and selected trusted contacts are eligible. Attachments and file metadata remain local-only and are never included. Release depends on the owner's chosen settings, which may include reminders, acknowledgement requirements, delay windows, unresolved missed check-in timing, and cancellation opportunities.
Once a released note has been accessed by a trusted contact, the owner may not be able to retract what the trusted contact has already viewed.
8. Local Vault and User Responsibility
Private notes and attachments may be stored in a local encrypted vault on your device. You are responsible for protecting access to your device, PIN, biometrics, backups, and local storage. If you delete the app, erase the vault, lose the device, or reinstall without a recoverable local backup, local-only content may not be recoverable.
9. Privacy and Encrypted Packages
KinSignal's backend is designed not to receive private note plaintext, local vault keys, or trusted contact private keys. Where release is enabled, the backend may store encrypted release packages only. Trusted contact decryption is intended to happen locally on the recipient's device.
10. Paid Features and Subscriptions
Some features may require an Advanced subscription or other entitlement. Subscriptions are processed by the app marketplace used for the purchase, and RevenueCat may be used to manage entitlement status. Billing terms, renewal, cancellation, refund handling, and account management are also subject to the terms of that marketplace.
11. Acceptable Use
You agree not to:
- Use KinSignal for unlawful, abusive, or fraudulent purposes.
- Attempt to interfere with service integrity, security, or availability.
- Misrepresent another person as a trusted contact without appropriate authority.
- Attempt to reverse engineer, scrape, or misuse the service beyond what applicable law allows.
- Upload or transmit content you do not have the right to use.
12. Suspension, Termination, and Account Deletion
We may suspend or limit access where reasonably necessary for security, abuse prevention, legal compliance, service integrity, or operational reasons. You may request deletion of your KinSignal cloud account in the app where available. Deleting your cloud account does not automatically erase local private notes or local keys on your device unless you also wipe local data.
13. Intellectual Property
KinSignal, including its software, branding, interface, and service materials, is owned by or licensed to its operators and is protected by applicable intellectual property laws. These Terms do not transfer any ownership rights to you other than the limited right to use the service in accordance with these Terms.
14. Disclaimer of Warranties
To the maximum extent permitted by applicable law, KinSignal is provided on an "as is" and "as available" basis. We do not warrant that the service will be uninterrupted, secure, error-free, timely, or suitable for every circumstance. We do not warrant that alerts, notifications, or note release will always arrive or be acted on.
15. Limitation of Liability
To the maximum extent permitted by applicable law, KinSignal and its operators will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of data, profits, goodwill, business opportunity, or personal outcomes arising from or related to use of the service. Where liability cannot be excluded, it will be limited to the minimum amount permitted by applicable law.
16. Changes to the Service or Terms
We may update KinSignal, change features, introduce or remove service limits, or update these Terms from time to time. Continued use after updated Terms take effect means you accept the revised Terms.
